Your use of any of our services will constitute acceptance of this Agreement and will have the same legal effect as if you were providing a handwritten signature of acceptance.

Please be aware that these terms of service do not in any way apply to the provision, administration and/or performance of any UK insurance policy distributed and/or administered through the app. They do not affect the rights and/or obligations of you, the app, or any other party to or person interested in any UK contract of insurance sold and/or administered through the app.

PLEASE READ CAREFULLY BEFORE USING VOYAGE VALET. YOUR USE OF THE SERVICE OR ANY SERVICES PROVIDED THROUGH VOYAGE VALET IS SUBJECT TO THESE TERMS. YOU AGREE TO BE BOUND BY THE TERMS PRESENTED BELOW. IF YOU DO NOT AGREE TO THESE TERMS, DO NOT USE VOYAGE VALET IN ANY WAY OR FOR ANY PURPOSE WHATSOEVER.

This Terms sets out the legal terms between you (either an individual or legal entity) and BnC Consulting SAS dba Bits'n Coffee (“Administration” or “we” or “us” or "Voyage Valet").

Acceptance of Terms

By using Voyage Valet, you agree to these Terms, which are effective upon your use and continue until terminated by either you or us. We strongly recommend printing a copy of these Terms for your records.

Eligibility

You must not use Voyage Valet if you are not legally entitled to use our services under the laws of your country of residence or are not of legal age to form a binding contract with us. By agreeing to these Terms, you confirm that you meet the age requirement or have obtained consent from your parent or legal guardian if necessary.

It is your responsibility to ensure that you are legally allowed to enter into this Agreement without breaching any laws in your jurisdiction.

Legal Restrictions

In certain jurisdictions, there may be legal restrictions on the use of Voyage Valet or related services. You are responsible for ensuring that your use of our services complies with local laws.

Compliance Notice

By using Voyage Valet, you agree to comply with the Children’s Online Privacy Protection Act of 1998.

Free Trial

Voyage Valet offers a free trial that allows you to access all features of the service, giving you a full experience of what we have to offer.

Right to Refuse Service

Voyage Valet reserves the right to refuse service to anyone at any time for any reason, including, but not limited to, misuse of the app, excessive usage that affects service operations, or violation of our terms of use.

Payment & Refunds

Voyage Valet services are available via the Apple App Store under a paid subscription model. Our pricing is clearly listed both in the app and on the App Store. We reserve the right to alter these rates or offer promotions at any time. Please note that all refund requests must be directed to the Apple App Store as we do not manage billing or refunds directly.

You can view your account details confidentially through the App Store. For any billing disputes, please contact the App Store directly.

New Features and Term Modifications

We continually strive to improve our service and may introduce new features or modify existing ones. We will update you on any significant changes to the features or terms via our website or app notifications. Changes in terms will take effect either from the moment you start using an updated feature or from your next billing cycle, whichever comes first.

Cancellation Policy

You may cancel your subscription at any time via the App Store. Please note that you will not receive a refund for any remaining balance. Furthermore, you are liable for all charges incurred until the cancellation of the service.

Limited License

Voyage Valet grants you a limited, non-sublicensable, non-exclusive, and revocable license to access and use our mobile applications and content strictly in accordance with these Terms and any applicable policies.

Under these Terms, it is prohibited to collect, use, copy, or distribute any content from Voyage Valet; resell, perform, or display any content publicly; modify or create derivatives of any part of our content; use any automated means to access or monitor Voyage Valet; or use the applications and content in any way that depletes our website's infrastructural resources, beyond the scope of intended use.

Notices and Claims

Voyage Valet may notify users of copyright infringement claims through general notices on our services, via email, or through postal communication. In line with legal standards, we reserve the right to terminate accounts of users who are repeatedly infringing copyright, at our discretion. We may also restrict or terminate service access for any users infringing on the intellectual property rights of others.

Termination of Terms

Voyage Valet reserves the right to suspend or terminate this Agreement or your access to the Services at any time, without limiting other remedies, if:

• (a) you breach these Terms;
• (b) you engage in illegal activities, infringe on any rights including privacy and intellectual property rights of others, or pose a legal risk or exposure to us;
• (c) it is necessary to comply with legal requirements within prescribed timelines;
• (d) you misuse the Services beyond their intended purpose;
• (e) you excessively use or abuse the Services, as solely determined by us; or
• (f) we decide to discontinue our Services.

Upon termination:

• (a) all your rights and licenses to use the Services will end immediately;
• (b) you must stop using the Services completely.

Voyage Valet may also modify any terms or guidelines related to the Services at our discretion and without liability. These changes will become effective immediately once posted on our site. Continued use of the Services after such postings will imply your acceptance of the revised Terms. Regularly review the Terms to ensure you understand the current terms applicable to your use of the Services. If you do not agree to the modified terms, your only recourse is to cease using the Services.

EXCLUSION OF WARRANTIES, LIMITATION OF LIABILITY AND INDEMNITY

NO WARRANTIES: TO THE MAXIMUM EXTENT PERMITTED BY LAW: THE SERVICES ARE PROVIDED “AS IS” AND AT YOUR SOLE RISK WITH NO WARRANTIES WHATSOEVER. VOYAGE VALET EXPRESSLY DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF QUALITY, PERFORMANCE, NON-INFRINGEMENT, MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE. VOYAGE VALET DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, ERROR-FREE, OR FREE FROM PACKET LOSS, NOR THAT THEY WILL ALWAYS BE AVAILABLE OR OPERATE WITHOUT INTERRUPTION OR ERROR.

NO LIABILITY: YOU ACKNOWLEDGE AND AGREE THAT VOYAGE VALET SHALL HAVE NO LIABILITY WHATSOEVER, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR ANY OTHER THEORY OF LIABILITY, IN CONNECTION WITH OR ARISING FROM YOUR USE OF THE SERVICES. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE SERVICES IS TO CEASE USING THEM.

Furthermore, you agree that Voyage Valet, nor any party involved in creating, producing, or delivering the services, shall be liable for any indirect, special, incidental, consequential, or punitive damages, or for loss of income, profits, goodwill, data, or business opportunities, regardless of whether the potential for such damages was disclosed in advance.

If a third party brings a claim against Voyage Valet related to your use of the services, your breach of these terms, or your violation of any rights of a third party, you agree to indemnify and hold Voyage Valet harmless from any damages, liabilities, costs, and expenses (including attorney’s fees) arising from such a claim.

Confidentiality and Security

At Voyage Valet, we prioritize your privacy and the protection of your personal information. All processing of your personal data, including traffic data and communication content, will be handled in strict adherence to our Privacy Policy, available at www.voyagevalet.app/privacy. We encourage you to review this policy thoroughly before using our Services.

Extra

These Terms establish the relationship between you, the user, and Voyage Valet regarding your use of our Services. If any part of these Terms is deemed illegal, invalid, or unenforceable by a competent court or administrative body, that part will be excluded from the Terms without affecting the rest of the document. A failure by Voyage Valet to enforce a right or remedy under these Terms does not waive our ability to do so later.

We may update these Terms periodically, and we'll post the changes at www.voyagevalet.app/terms. Changes take effect immediately upon posting. Regularly reviewing these Terms is encouraged. By continuing to use our Services after changes are published, you accept the revised Terms. If you disagree with the updated Terms, you may terminate this agreement as outlined below.

If external forces beyond our control prevent us from delivering the Services, we will not be considered in breach of our obligations under these Terms.

These Terms are governed by the laws of France, without regard to its conflict of laws principles. Any legal actions related to these Terms will be subject to the jurisdiction of French courts, and all parties consent to this jurisdiction and venue. We reserve the right to seek injunctive relief in any jurisdiction necessary.

These Terms were originally written in English (US). If a translation is provided, it is for your convenience only. In case of discrepancies between the English version and any translation, the English version will prevail.

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOU HAVE READ THESE TERMS AND UNDERSTAND ALL RIGHTS, OBLIGATIONS, TERMS AND CONDITIONS SET FOR VOYAGE VALET. BY CONTINUING TO USE THE SERVICES YOU EXPRESSLY CONSENT TO BE BOUND BY THESE TERMS YOU GRANT TO ADMINISTRATION THE RIGHTS SET FORTH HEREIN.
